Arrest Made in N.J. Walmart 'All Black People' Case
« on: March 20, 2010, 10:30:15 AM »
This should be interesting. I can not to see what the chargers are.

WASHINGTON TOWNSHIP, N.J. - An arrest has been made in the case of a racial comment being made over the public-address system at a Walmart store in southern New Jersey, police said.

The Washington Township Police Department said on its Web site early Saturday that an arrest has been made in a "bias incident" at the retail store. The posting said police and Gloucester County Prosecutor's Office will announce the arrest at a midday news conference.

Police and prosecutor's office spokesman Bernie Weisenfeld declined to comment Saturday.

A male voice came over the Walmart public-address system Sunday evening and calmly announced: "Attention, Walmart customers: All black people, leave the store now."

Although a manager quickly apologized for the remark over the intercom, many customers expressed their anger to store management.

This should be interesting. I can not see what the charges are...

Many states and cities have laws, even in Idaho, that are considered a hate crime.  It's called "ethic intimidation".

Here are just some of Idaho's laws:

1.Idaho's Malicious Harassment Act (adopted in 1983) - In Idaho it is a felony to maliciously harass any person because of race, color, national origin, religion, or creed. This offense is punishable by up to five years in the Idaho State Correction Institution and a $5,000 fine for each occurrence.

2.Idaho's Civil Remedies Act (adopted in 1987) - A victim of malicious harassment as defined above, may sue the harasser for actual damages, punitive damages and attorney fees.

3.Idaho's Domestic Terrorist Control Act (adopted in 1987) - If two or more individuals engage in paramilitary training in Idaho, they can be sentenced for up to 10 years in the Idaho State Correctional Institution and fined up to $50,000.

4.Uniform Hate Crimes Reporting Act (adopted in 1989) - This act requires all law enforcement agencies in Idaho to specially report to the State Department of Law Enforcement all hate crimes committed on the basis of race, color, national origin, religion, or creed.

."...ethic intimidation".

Hmmm...sounds philosophical.

What's the reference on this one?  Doesn't pop up when i search for it at the Idaho code and statute site.  I want to look at the definitions and such since a lot of the events and even some of the informal gatherings could be construed as to fall under that broad meaning.

From what I've been able to locate, five pieces of legislation were adopted, starting in 1987, designed to promote human rights.  These were adopted in order to combat the Aryan Nations harassment in Coeur d'Alene and Hayden Lake (in Kootenai county).  They were:

1) a domestic terrorist control act (18 Idaho Code § 8101) that limited the paramilitary training practices of hate groups;

2) the proclamation of Martin Luther King, Jr.’s birthday as a commemorative holiday;

3) a civil remedies amendment to the malicious harassment legislation of 1983 (18 Idaho Code § 7901) that allowed victims to file for civil remedies if they were attacked;

 4) a uniform bias crime reporting act in 1989 (67 Idaho Code § 3001);

 5) the establishment of a Hispanic Commission (67 Idaho Code § 7201) to represent the largest minority group in the state.

Thanks GW.  It is clarified in that statute as "conspiracies and training activities in furtherance of unlawful acts of violence..."  That's what I was curious about.
