Legal question..

Hello all
Maybe someone can help me.

I just sold a pistol to a friend of mine and he is wondering about doing a transfer..i.e getting it registered though the sheriffs..

I told him a bill of sale will work out with all the correct info(  serial number, out info, etc..)
Will this work?

REGISTER?  You must not be from Idaho.  We register criminals and sex offenders, not firearms.  It is a unique concept but it works.

Firearms are not registered in Idaho.  If you buy one from a FFL dealer he keeps the original paper work.  It is not sent in.  No agency - state, county or city requires registration. 

No paper work of any kind is REQUIRED on a private transfer.

Unless is is class 3.  :(

Since it's legal to sell (gun shop) a long gun to states that border Idaho is it legal for you to sell (private deal) a long gun also to resident that borders Idaho?  Seems it would be OK but I don't know.

From reading the law, as long as it is a long gun - shotgun or rifle - you can sell it across state lines private party.

culloden, I don't think the Sheriff even can register the handgun, as they wouldn't know what to do with it if you brought it in. Then again the goon from Ada County might have a program for that under the cloak of insurance purposes.

Well what the ATF tells me is that they would "like" you to use a bill of sale.  It would be in your best interests, if this guy goes and shoots someone and the feds get back to you then you have some way to redirect them.  All pistols have one round fired at the factory, those balistics are given to the FBI for data base since most crimes involve handguns.  By no means do you have to do it.  As far as the 4473, ffls have to keep it for 20 years.  If they go out of business before then then all paperwork gets turned over the the ATF.  Hope this helps.

Resurrecting a bit of an old thread here but I  have a related question.

My brother will be visiting from Kali in the next month or so and wanted to know whether he could purchase an HK45.  He wanted to know if it was legal for him to buy one while he was here.  I am pretty sure that he'd need to have it sent to an FFL back in CA, but wanted confirmation.  Also, is there any difference in the law for a non-resident between buying from a shop vs. private sale?

He could buy it from anybody here but have to send it back to a CA FFL if his only residence is in CA. If he has a residence in ID he can buy it here.
