Private buy/sell/trade questions

I'm not sure if this has been asked here before, it's a hard one to search for.  I have questions about implications of buying, selling, or trading firearms.

Scenario 1:  You buy a firearm through a shop like Impact or Cliffs where they do all the paperwork, call NICS, etc.  Somewhere down the line you sell or trade it to someone else who may sell or trade it and so on.  Way down the line the firearm you originally bought gets used in a crime.  Can it come back on you since you were the original purchaser and the only paperwork that may have ever been filed shows you as the owner?

Scenario 2:  You buy or trade a firearm privately from someone.  Sometime in the past that firearm was used in a crime but you are unaware of that fact.  Can you get yourself in trouble by owning it?

I know there could be lots of variables and those scenarios are not perfect but you get the idea.  How do you CYA when buying/selling/trading privately?  I'm considering selling one of my guns but want to know if there are possible repercussions.

I purchased a single shot 12 guage for my son for pigging one season. We used it one year until we got him something better. Last year,, mind you two years later, it was used in some crime in canyon county. Some punk had purchased it from the guy I sold it to. Moron even cut it down to a pistol grip and 5 inch barrel. I got a call from a detective in CC. We had a conversation about it. That was it.

Keep in mind the weapon you own that is most likely to be resold and used in a crime isnt your 1500 dollar AR or your custom colt commander, its the cheap piece of crap you get rid of because its just that.

I wouldnt worry about it, you have no real liability the way I understood the conversation.

No, but you might be investigated (as Hubby_MC said).

No, but they might be able to take it from you as evidence in their investigation.

ah, yes, if it was used in a crime. so if you go to purchase a gun from a private person be on the lookout for the following clues.................

1. the gun ha seaweed in it (dropped in the drink)
2. The gun has no serial numbers anywhere on it and a lot of scrape marks
3. The gun has engraved on the side "Cop killer"
4. The guy wants $5.00 for a 2500 dollar pistol
5. The guy tells you he has to "unload this hot one" real fast!
6. The guy is wearing prison orange jumpsuit at time of purchase and the negotiations have been
carried out over the Idaho Prison Registry E-mail autihority proxy

;D  Yes, well those would be obvious.  I was thinking more along the lines of buying it two or three owners down from someone that you maybe know but was unaware of the past use.  I think common sense would dictate (I hope) staying away from sales like the ones above.  It's obviously hard to know the history regardless of what side of the deal you are on unless you buy it new yourself or trust the person you are receiving it from explicitly.

I couldnt agree more, knowing the guy our buying it from helps a great deal.

If you are really concerned, or you have a firearm you are not sure about then call the local law enforcement and they will run a check on the serial numbers for free!!!!!

 If you have any feelings that what you are buying is "hot" "stolen"
give the serial numbers to lawenforcement they can check it out,
get a bill of sale from them check their ID so you have the right
person. When in you dont feel right about it leave it.
 yes you can get in REAL: trouble with a stolen fiirearm in your
hands s. have the proof handy.
 selling a gun to a private party is ok no paper work needed,
keep a date to whom you sold it to and the amount of the sale.
check numbers, money orders what went with the sale.
 Or to protect yourself take it to some one who has a ffl impact
or cliffs etc.. and run it through their books....
