Idaho State Parks Carry?
« on: July 19, 2011, 03:09:40 PM »
This past weekend we went camping at Cascade Lake State campground with several other families. When camping I usually open carry (makes the north enders really edgy). We went for a walk through the camp to locate facilities, trash, etc. While walking we noticed the rules board and listed under personal protection header was...
600.PERSONAL SAFETY, FIREARMS.
No person may purposefully or negligently endanger the life of any person or creature within any land administered by the Department. No person may discharge firearms or other projectile firing devices within any lands administered by the Department, except in the lawful defense of person, persons, or property or in the course of lawful hunting, or for exhibition or at designated ranges as authorized by the Director. (3-29-10)

EXCEPT on the version posted at the park was "No firearms allowed in State Parks. Firearms must be unloaded at all times and locked in vehicle out of sight" was added, and the "except in the lawful defense of person, persons, or property" section was not there !

The above rule header #600 came out of the State park rules website and had no mention as written about guns being unloaded and locked at all times.
My question is which rule is correct? Has policy been changed and Cascade has old signage up, or is it a make em up as we see fit at individual campgrounds. I immediately covered my weapon and when retuning to camp unloaded my rifle but kept my pistol CC. Ten minutes later a marked police vehicle drove very slowly through camp, but did not stop. Has anyone heard of this clause and would I have been in trouble for open carry?

I'd like to know the answer to this as well.  As far as I know, you can carry in all State Parks in Oregon, including National Parks.  It is unconstitutional for any state to enforce restrictions for legal permit holders to prevent them from carrying in State Parks.  If this rule is true, then the State of Idaho is circumventing the Federal law. I wouldn't expect this from a pro-gun state like Idaho.  Oregon ,certainly makes no such prohibition.  However, I'd like to know for a fact if what you saw is some outdated sign or if there are restrictions I don't know about.  How could it be that you can carry in National Parks, but not State Parks?  Also, don't you have a list of laws when you receive an Idaho CHL?  It should list where you are prohibited from carrying. Are State Parks on this list?

Recreational Lands Self-Defense Act (H.R. 1865) passed in 2009 repealed the gun ban on National Park Service land. It became Public Law 111-024.
However, it does not (yet) cover Army Corps of Engineers property which controls 400 lake and river projects, 90,000 campsites and 4000 miles of trails in the U.S.

So if the campsite is National Parks or Idaho State Parks land you can carry openly, if it is Army Corp of Engineering land you cannot.

There is an amendment currently in the works that will remove the gun ban in A.C.E. land and bring it in line with the Recreational Lands Self-Defense Act.

This week, the House of Representatives Appropriations Committee approved amendments blocking the use of federal funds to implement two controversial schemes by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and it rejected amendments proposing two of gun control groups’ other top priorities.  In addition, the full House adopted a provision protecting gun possession on Army Corps of Engineers land.

+1.  Well stated.

Personally, the whole (where you can and can't carry) thing is BS!  I'm still looking through the 2A to try and find anything, anything at all that restricts ownership, concealed or non concealed, size, caliber, semi or auto, or where anything "federal" automatically means no firearms allowed.  Where does it say we need permits and permission or face imprisonment by veering off the very narrow road of laws and policies which only tighten around us every day squeezing out more and more fundamental liberties. Can't fu@#ing find it! Someone help me out here.  WE are the frikking national guard, and department of homeland security!  That's what I see when I read through the Bill of Rights.
I will end on that note before I'm urged to move the comment to the "rant and rave" category.

You are correct, there should be no restriction on American Citizens with regards to firearms...

However, the law has been so distorted to protect the innocent from being frightened of a piece of metal that the original meaning has been lost.

That said, we much choose where and when to fight our battles... I prefer to CCW 99% of the time and where there is question to my legal authority to do so, and if I should need it, I'll fight the battle then on my justification.

Making a case to a local LEO on my rights, and getting all bent out of shape while I'm relaxing in the woods, is not the battle I wish to fight.

Agreed,  just a moment of clarity as we reflect on how far we've come down the road from the original intent of the founders.  Once freedoms are lost, there's no getting them back.  The least we can do is stop the erosion of our liberties before we all wake up in Russia one day. :o

Thank you to all who have replied. I agree with Luvmy45 about having a local LEO search my tent and car in front of my six and two year old, while I try and prove that I am "ALLOWED" to have this piece of metal on my person. Looks like I will stick with the sage advice of CCW and justify my reason and legality on my terms.

http://www.ag.idaho.gov/concealedWeapons/concealedWeapons_index.html#Are there places where I cannot carry a concealed weapon even with a permit

Are there places where I cannot carry a concealed weapon even with a permit?

Yes. You may not carry a concealed weapon in a courthouse, juvenile detention facility, adult correctional facility, prison, jail, public school or private school.

Federal law may prohibit you from carrying a weapon in places such as federal courthouses and airports.

If you have any doubt, you should contact the government entity prior to carrying a weapon onto its premises.

If we can not carry legally in state parks because of some administrative rule, we should be raising hell about it with our state politicians...
