concealed carry question...
« on: May 07, 2011, 11:59:20 AM »
So, this came up in conversation....
Concealed carry at the knitting factory on fight nights.
Legal or not? I've never been there so I honestly don't know...

It's been awhile but to the best of my knowledge, The Knitting Factory serves alcohol which would make CCW a no go...in my non educated opinion.
Due to the actions of the offender...

I'm a layman but I think the law is silent on the topic of carry at a bar, but it says you can't be drunk... That being said I've seen them do pat downs at the door so I image they'd 86 you.

This sounds right to me.

Are there places where I cannot carry a concealed weapon even with a permit?
You may not carry a concealed weapon in a courthouse, juvenile detention facility, adult correctional facility, prison, jail, public school or private school.
Federal law may prohibit you from carrying a weapon in places such as federal courthouses and airports.

May I carry a concealed weapon in private businesses that are open to the public?
Yes, unless the private business, which is open to the public forbids carrying weapons on the business premises. Private businesses are within their rights to prohibit weapons on their property.

I do remember from my CCW course that on the latter issue, what they don't know won't hurt them.  Carry while intoxicated is a no go, but carry in establishments that serve alcohol is still ok.

JUST FYI,
The knitting factory prohibits weapons being carried on thier property.  It is their company policy that no firearms are allowed.

Just to clarify, can anyone cite the consumption law? Is it zero consumption or intoxicated being around the .08% limit? Granted it's not a good idea to drink at all while carrying, but what is the actual wording?

i believe the standard is "impaired to the slightest degree". This is the standard for DUI but they add the .08 as the point where the law presumes you to be intoxicated.

If you ever get charged with an alcohol related offense, ie... DUI, Public Intox, Disturbing the Peace, Disorderly Conduct, etc.  while carrying a concealed weapon you will receive additional charges and loose your CCW.
So here is my two cents as a local LE Professional.  If you are going to consume alcohol.... Do not carry.

Pretty easy to figure out if you take the time to look it up.   ::)

When the last elk vanishes from the hills,

I know the guy that's head of security there, BIG SOB, not an anti gun guy at all. It's just their policy.

I use to be a band photographer and the knitting factory aka The big easy was one of the worst places for taking pictures and their security was at times overboard with their heavy handed way of handling things.  It got to where I would refuse to do pictures there.   But yet with the odors that were coming from the green room...wow I almost would get a contact high.

When you come in the back door, you can pretty much do whatever you want, whenever you want with whomever you want.

The front door rules don't apply to those that come in the back door.

True store, I was carrying a 5" 1911 iwb with a mag and a surefire on the weak side...I was patted down at the big easy... the "security guard" touched the objects on both sides of my waist and did not say a thing...walked right in... that was for Chevelle - maybe casue i was older she thought i was a cop??? I have also been padded down at the Idaho Center with the same rig and the same results. Those were the only two times I have been frisked while carrying.
